Forms of Business Legalization in the Member Countries of the Andean Community of Nations: A Comparative Analysis and Its Implications for Ecuador

Abstract

Business formalization has become a key element for economic development, competitiveness, and sustainability, especially in developing countries where micro, small, and medium-sized enterprises predominate. In this context, the Andean Community of Nations (CAN), made up of Peru, Ecuador, Bolivia, and Colombia, has promoted a set of instruments aimed at strengthening business 
formalization in order to reinforce the productive environment and foster regional economic integration. This article aims to analyze the CAN regulatory framework related to business formalization and its application in Ecuador. The research was conducted under a qualitative approach, using a casestudy design, with bibliographic review as the main technique, through which laws, regulations, institutional programs, and official documents related to business formalization processes in each country were identified. On the other hand, the results showed that Ecuador has a 
solid regulatory framework; however, it presents limitations such as administrative complexity, limited institutional integration, and restricted access to information regarding the benefits and processes of formalization. 
Therefore, Andean regulations constitute a key 
foundation for strengthening business formalization; nevertheless, their effectiveness depends on the implementation carried out by each Andean country and on the proper application of instruments aimed at reducing the barriers that directly influence business informality.
